Terms and Conditions

1. Introduction and Agreement

These Terms and Conditions ('Terms') govern your participation in the Bike Club Ambassador Programme ('Programme'). By applying to and participating in the Programme, you ('Ambassador', 'you', 'your') agree to be bound by these Terms in full.

These Terms constitute a legally binding agreement between you and Bike Club ('we', 'us', 'our'). Please read them carefully before submitting your application. If you do not agree to these Terms, you must not participate in the Programme.

We reserve the right to update or amend these Terms at any time. Continued participation in the Programme following notification of any changes constitutes your acceptance of the revised Terms.


2. Eligibility

To be eligible to participate in the Programme, you must:

  • Be an active Bike Club member at the time of application and throughout your participation;
  • Be aged 18 years or over;
  • Have parental or legal guardian responsibility for any child featured in the content you submit;
  • Hold all necessary rights and permissions to submit the content you provide; and
  • Comply with the social media platform terms of service applicable to any content submitted.

Bike Club reserves the right to verify eligibility at any time and to disqualify any Ambassador found to be ineligible.


3. Content Submission

3.1 What We Are Looking For

We welcome authentic, high-quality video content showcasing your family's experience with Bike Club. Suitable content includes, but is not limited to:

  • Your child enjoying their Bike Club bicycle;
  • Family rides and cycling adventures;
  • First pedalling or milestone moments;
  • Your reasons for choosing Bike Club;
  • Tips, advice, or personal experiences as a Bike Club member; and
  • Any other content that captures the joy of cycling with Bike Club.

3.2 Submission Requirements

When submitting content, you must:

  • Submit videos in a format and resolution that meets Bike Club's quality standards (details provided upon acceptance to the Programme);
  • Ensure all content is original and created by you;
  • Ensure that any individuals featured in the content, including children, are people for whom you have the legal authority to grant the permissions set out in these Terms; and
  • Not submit content that features third parties without their prior written consent.

3.3 Content Standards

All content submitted must:

  • Be family-friendly and appropriate for all audiences;
  • Accurately represent Bike Club and its products;
  • Comply with all applicable laws, including advertising standards and regulations;
  • Not be defamatory, offensive, discriminatory, or otherwise objectionable; and
  • Not include any third-party brand, logo, or intellectual property without prior approval.

Bike Club reserves the right, at its sole discretion, to reject any content that does not meet its quality standards or that it considers unsuitable for any reason. We are not obliged to use or share any content submitted.


4. Content Featuring Children — Important Notice

Please read this section carefully. By submitting content that includes images or videos of children, you are granting Bike Club permission to publish that content publicly on social media and other marketing channels.

As part of the Ambassador Programme, the content you submit may include images and videos of your child or other minors in your care. By participating in the Programme and submitting such content, you explicitly acknowledge and agree to the following:

  1. Images and videos of children submitted through the Programme may be shared publicly on Bike Club's social media channels, including but not limited to Instagram, Facebook, TikTok, YouTube, and Pinterest.
  2. Such content may also be used in Bike Club's wider marketing and promotional materials, including paid social media advertising, email marketing, the Bike Club website, and printed or digital marketing collateral.
  3. You are the parent or legal guardian of any child featured in the content you submit, and you have full legal authority to grant permission for that child's image and likeness to be used for commercial purposes.
  4. You have considered and are comfortable with your child's image and likeness being visible to the general public via Bike Club's marketing channels.
  5. Once content has been published by Bike Club, it may not be possible to fully remove it from all platforms. You accept this risk when submitting content.
  6. Bike Club will not identify children by their full name in published content without your prior consent, but may use first names or general descriptors (e.g. 'age 5').

If at any time you no longer wish for your child's image or likeness to be used in future content, you must notify us in writing at info@bikeclub.com. We will make reasonable efforts to remove the content from our active channels, but cannot guarantee removal from all third-party platforms on which it may have been shared.


5. Licence to Use Content

5.1 Grant of Licence

By submitting content to the Programme, you grant Bike Club a non-exclusive, royalty-free, worldwide, perpetual, irrevocable licence to use, reproduce, edit, adapt, publish, translate, distribute, sub-licence, and display the content (in whole or in part) for any commercial or non-commercial purpose, including but not limited to:

  • Social media posts and paid advertising on any platform;
  • Email marketing and newsletters;
  • The Bike Club website and app;
  • Press releases and media coverage;
  • Printed marketing materials, in-store displays, and point-of-sale materials;
  • Broadcast, online, and streaming media; and
  • Any other marketing or promotional activity at Bike Club's discretion.

5.2 Branding and Editing

Bike Club may add branding, text overlays, music, or other elements to your content. We may also crop, edit, or reformat content as required for different platforms or uses. We will not make edits that materially misrepresent you, your family, or your experience with Bike Club.

5.3 Attribution

Bike Club will make reasonable efforts to credit Ambassadors when sharing their content on social media, but is not obliged to do so in all instances, particularly where content is used in paid advertising or other commercial formats.

5.4 Ownership

You retain ownership of the original content you submit. The licence granted above does not transfer ownership of your content to Bike Club.


6. Warranties and Representations

By submitting content and participating in the Programme, you represent and warrant that:

  • You are the sole author and owner of the submitted content, or have obtained all necessary rights and permissions to submit it;
  • The content does not infringe any third-party intellectual property rights, including copyright, trade marks, or privacy rights;
  • You have the full legal authority to grant the licence described in Section 5, including in respect of any individuals featured in the content;
  • The content is accurate, not misleading, and complies with all applicable advertising regulations including the UK Advertising Standards Authority (ASA) guidelines and CAP Code;
  • You will clearly disclose any brand partnership or gifted arrangement in accordance with applicable advertising disclosure rules; and
  • The content does not contain any material that is defamatory, offensive, discriminatory, or otherwise unlawful.

7. Reward Structure

Ambassadors whose content is selected and published on Bike Club's social media channels will receive a reward of free subscription months as communicated at the time of acceptance into the Programme. The following conditions apply:

  • The reward is only payable if your content is selected at Bike Club's sole discretion and actually published on a Bike Club social media channel;
  • Submission of content does not guarantee selection or reward;
  • Rewards are non-transferable and have no cash equivalent;
  • Bike Club reserves the right to modify the reward structure at any time, with notice provided to active Ambassadors; and
  • Any reward will be applied to the subscription account associated with your Ambassador application.

8. Ambassador Conduct

As a Bike Club Ambassador, you agree to:

  • Represent Bike Club in a positive and professional manner in all public communications related to the Programme;
  • Not make any false or misleading statements about Bike Club, its products, or services;
  • Not engage in any activity that could bring Bike Club into disrepute; and
  • Comply with all applicable laws and regulations, including social media advertising disclosure requirements.

Bike Club reserves the right to terminate your participation in the Programme immediately if, in our reasonable opinion, you breach any of these obligations or otherwise act in a manner inconsistent with our brand values.


9. Termination

Either party may terminate an Ambassador's participation in the Programme at any time by providing written notice to the other party.

Upon termination:

  • You must cease representing yourself as a Bike Club Ambassador;
  • Any outstanding rewards that have been earned (i.e. content has already been published) at the point of termination will still be honoured; and
  • The licence granted under Section 5 will survive termination and Bike Club may continue to use previously submitted content in accordance with these Terms.

10. Privacy and Data Protection

Bike Club will process your personal data (including your name, contact details, social media handles, and the personal data of any children featured in content you submit) in accordance with our Privacy Policy, available here.

By participating in the Programme, you consent to Bike Club processing the personal data of any children featured in your content for the purposes described in these Terms. You confirm that, as the parent or legal guardian of those children, you have the authority to provide this consent on their behalf.

We will retain content submitted through the Programme for as long as necessary to fulfil the purposes described in these Terms, unless you request earlier deletion in accordance with Section 4.


11. Limitation of Liability

To the fullest extent permitted by law, Bike Club shall not be liable for any indirect, incidental, special, or consequential loss or damage arising from your participation in the Programme.

Nothing in these Terms limits Bike Club's liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.


12. General

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12.2 Entire Agreement

These Terms, together with Bike Club's Privacy Policy, constitute the entire agreement between you and Bike Club in relation to the Programme and supersede all previous communications, representations, or agreements.

12.3 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

12.4 No Waiver

Failure by Bike Club to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision in the future.

Ambassador Acknowledgement

By submitting your application to the Bike Club Ambassador Programme, you confirm that you have read, understood, and agree to these Terms and Conditions in full, including the provisions relating to the use of your child's image and likeness for commercial purposes.
